Drug trafficking is the most serious of all drug crimes in Massachusetts. Along with each conviction, a mandatory minimum state prison sentence needs to be served in order to obtain eligibility for parole.

  • If you are charged with marijuana trafficking, you face a Class D felony conviction and the following penalties based on the amount in possession upon arrest:
  • 50 pounds or more – Prison sentence ranging from two and a half to 15 years, or one to two and half years in jail, with a mandatory minimum sentence of one year.
  • 100 pounds and up to 2,000 pounds – Prison sentence between three and 15 years, with a mandatory minimum of three years.
  • 2,000 pounds and up to 10,000 pounds – Prison sentence ranging from five to 15 years, with a mandatory minimum of five years.
  • 10,000 pounds or more – Prison sentence between 10 and 15 years, with a mandatory minimum of 10 years.
  • If you are charged with cocaine trafficking, you face a Class B felony conviction and the following penalties based on the amount in possession upon arrest:
  • 14 grams and up to 28 grams – Prison sentence between three and 15 years, with a mandatory minimum of three years.
  • 28 grams and up to 100 grams – Prison sentence between five and 20 years, with a mandatory minimum of five years.
  • 100 grams and up to 200 grams – Prison sentence ranging from 10 to 20 years, with a mandatory minimum of 10 years.
  • 200 grams or more – Prison sentence ranging from 15 to 20 years, with a mandatory minimum of 15 years.
  • If you are charged with heroin trafficking, you face a Class A felony conviction and the following penalties based on the amount in possession upon arrest:
  • 14 grams and up to 28 grams – Prison sentence between five and 20 years, with a mandatory minimum sentence of five years.
  • 28 grams and up to 100 grams – Prison sentence between seven and 20 years, with a mandatory minimum sentence of seven years.
  • 100 grams and up to 200 grams – Prison sentence of 10 to 20 years, with a mandatory minimum sentence of 10 years.
  • 200 grams or more – Prison sentence between 15 and 20 years, with a mandatory minimum sentence of 15 years.
