Fighting An OUI

If you have already been arrested for operating a vehicle under the influence of drugs or alcohol, there are many different steps that you can take to fight these charges, but you must be prepared to act quickly.

It might seem the simplest possible solution to take a plea bargain, but in doing so you admit your own guilt.  Your options are therefore limited if you accept guilt earlier on in the case.  If you want to fight your OUI case to have the best possible chance of having it dismissed, follow these steps to improve your chances of outright dismissal, a not-guilty verdict, or reduced charges:

1. The first thing that you can do is to hire a knowledgeable OUI trial attorney.  When the prosecution know that you have taken your case seriously by retaining an attorney who has a track record of fighting against illegal arrest in Massachusetts or ones who is experienced in identifying evidentiary problems.  They may be more likely to work towards a dismal or reduction in charges while you still have a chance to navigate the system and explore your options. Bear in mind that a good lawyer will help you understand whether or not a plea bargain truly is in your best interests.

2. The second thing you can do after being accused of an OUI in Massachusetts is to identify the evidence.  In many OUI cases across the state, the evidence is not as strong as the prosecution would have you believe.  In many situations, breathalyzer results have already been thrown out in the state overall Massachusetts due to hundreds of machines that were never properly calibrated.

3. Verify whether or not the traffic stop was legal.  This something that can be accomplished by sharing your concerns directly with a lawyer who is well-versed in how you should respond to OUI allegations. Your criminal defense lawyer should be familiar with all aspects of fighting back on your behalf and should be willing to look into various options to protect you going forward so that you have the best possible chance of avoiding criminal charges.

No matter the circumstances of an OUI arrest, it’s up to you to fight for your rights.
