What Triggers a Felony OUI Charge in Massachusetts?
Most OUI offenses in Massachusetts are charged as misdemeanors. Several circumstances elevate the charge to felony level, each carrying mandatory incarceration and consequences far beyond those of a first or second offense.
Third or Subsequent OUI
Massachusetts’s lookback period for criminal charging purposes is unlimited. Any prior OUI conviction, regardless of when it occurred, counts toward the offense number when determining whether a charge is filed as a felony. A third OUI conviction carries a mandatory minimum of 150 days served of a 180-day sentence, up to 5 years in state prison if indicted, fines of $1,000 to $15,000, and an 8-year license suspension. An ignition interlock device (IID) is required upon reinstatement, and a hardship license may be available after two years.
OUI with Serious Bodily Injury
When an OUI offense results in serious physical injury to another person, the charge carries a mandatory minimum of 6 months and up to 2.5 years in a House of Correction, or 2.5 to 10 years in state prison if indicted. Fines range from $1,500 to $5,000, and the license suspension is 2 years.
Motor Vehicle Homicide by OUI
When an OUI offense causes a death and involves wanton or reckless conduct, the charge may be prosecuted as motor vehicle homicide by OUI under MGL c. 265 § 13½. A conviction carries a mandatory minimum of 5 years and up to 20 years in state prison, fines of $2,500 to $25,000, and a 15-year license suspension. This is among the most seriously prosecuted offenses in Hampshire County courts.
Child Endangerment OUI
Operating under the influence with a child under 14 in the vehicle results in a separate felony charge. Penalties include 90 days to 2.5 years of imprisonment, fines up to $5,000, and a 1-year license suspension. Law enforcement is required to notify the Department of Children and Families (DCF), which may open an independent investigation.
